Your contract is with eMall Nigeria Limited and you undertake that all goods ordered by you from www.mallmentum.com are for your own private use only and not for resale.

You ensure that all details you provide to www.mallmentum.com for the purpose of ordering or purchasing goods are true, accurate and complete in all respects; and that the credit or debit card you used to purchase is your own card with sufficient funds in your account to make a payment of the product(s) ordered.

You agree that if you break these Terms and Conditions, or any liabilities are incurred arising out of your use of www.mallmentum.com, you will be responsible for the costs and expenses incurred as a result of the breach, including reasonable legal fees. Your Account

You can terminate your account with www.mallmentum.com at any time from your account settings. Terminating your account will not free you from payment of any outstanding bills. If you or www.mallmentum.com terminate your account, we do not hold any responsibility for any information loss associated with your account.

OUR PRODUCTS

The images of the Products on our site are for informative purposes only. We always try to display the colors accurately, though we cannot guarantee that your computer’s display accurately reflects the color of the Products. Your Products may vary slightly from the pictures in www.mallmentum.com.

We try to get Product descriptions, pricing and specifications maximum correct, but specifications may change and we reserve the right to withdraw or substitute items if needed. Products are subject to availability, while stocks last and may be available in limited quantity only.

ORDERS

www.mallmentum.com order process allows you to check and amend any information before submitting your order to us. Please take the time to read and check your order at each page of the order process.

After you place an order, you will receive an e-mail from us confirming receiving of your order. Please do not consider this e-mail as the acceptance of your order. Your order is accepted once we e-mail you with confirmation that the products you ordered have been dispatched.

The Contract between us will only be formed upon this confirmation. If we are unable to supply you with a product by any reason, we will inform you by e-mail and we will not process that part of your order where the product is included. If you have already paid for the order which cannot be delivered, we will refund you the full amount charged as soon as possible, in the case of a multiple products order we will refund only that element of the order which contains the product. If only part of your order is available, we will only dispatch the items that are in stock, and cancel the out of stock items.

PAYMENT

The payments for orders are made by VISA or MasterCard credit or debit cards in USD Dollar and EURO currencies. You authorize us to debit your card with the total cost of the products selected. Any refunds made in respect of returns or cancellations will be made to the same card. If the payment has not been made in full, we may cancel your order and/or suspend any further deliveries to you.

LOSS OR DAMAGE

This clause is not intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence. The risk of damage or loss of the Products passes to you when delivery is made. Delivery is made at the time we leave the Products at the address specified by you. We cannot accept any claims beyond this point. All implied warranties and undertakings are excluded to the maximum extent permitted by law.

DELIVERY OF THE GOODS

www.mallmentum.com is proud to offer a free and efficient worldwide delivery service. For deliveries within Nigeria, the delivery will take from 1 to 5 working days after you place the order. For International orders, delivery will be done within 10 to 20 working days after the order is placed. We will package and ship your items to ensure your product reaches you in perfect condition.

Please note that your order will only be shipped once payment and delivery details have been approved.

RETURN POLICY

Our goal is for customers to be happy with their purchase. But things may not always go as planned. If things don’t go as planned, contact us and we will try to make things right for you.

You have to place your request for a return or a refund within 30 days of the date of delivery. If the order does not arrive you can place your refund request within 30 days of the estimated date of delivery.

If you have changed the decision regarding your order you can cancel it within 8 hours of the time it was placed.

If you receive an item that is damaged, different, or not of the size or colour you ordered, you can request a refund. We will request a photo of the product and you may be required to return the item.

After we approve a cancellation or refund and confirm the return of the item, www.mallmentum.com will return the amount of the purchase to your original payment method within 3-5 working days. Return shipping fees will not be refunded to the customer.

APPLICABLE LAW

You agree that the laws of the Nigeria, without regard to principles of conflict of laws, will govern these Terms and any dispute of any sort that might arise between you and www.mallmentum.com.

INDEMNITY

To the fullest extent allowed by applicable law, you agree to indemnify and hold eMall Nigeria Limited, its affiliates, officers, agents, employees, and partners harmless from and against any and all claims, liabilities, damages (actual and consequential), losses and expenses (including attorneys’ fees) arising from or in any way related to any third party claims relating to your use of www.MALLMENTU.COM including any actions taken by any third party using your account, and your violation of these Terms and Conditions. In case of such a claim, suit, or action, we will provide a notice to the contact information we have for your account (provided that failure to deliver such notice will not eliminate or reduce your indemnification obligations hereunder).

VALIDITY OF TERMS AND CONDITIONS

If any provision of the Terms and Conditions is declared invalid by a court decision, the remaining provisions remain in force.
